As for GTA IV Offline, You will not get banned at all for doing that in offline mode, you just got to becareful doing it in online mode. The Moderators/Admins don't care anymore unless other players report you properly to the right people with evidence like a screen shot, A video or something like that otherwise I don't think you will get banned for doing it on GTA IV Online.
